Oshawa Separation Lawyers
In family law, separation is the breakdown of a relationship. Both married and common-law couples can separate.
If you separate, you and your former spouse/partner will need to make decisions and arrangements about a number of different issues — such as how to deal with your
family residence and who will pay family debts. If you have children, you will also need to make decisions about
who will take care of the children and
how the children will be supported financially. Any consensus the separating couple reaches on these issues forms the basis of their
separation agreement (i.e. how their relationship will be structured following the breakup, and as they head towards potential
divorce).
If you are considering a separation, or have already begun the process, you should consult with a knowledgeable family lawyer as soon as possible. A family lawyer will explain what you can expect in the separation process, will outline your legal obligations throughout, and will help you proactively plan for your new reality. At
Borden Family Law, our practice is focused exclusively on family law. We have been advising clients on separation and related matters for more than 17 years.
The Difference Between Separation and Divorce
Separation is the first step towards obtaining a divorce. A separated couple remains legally married, but live “separate and apart” from one another. This may mean the parties live apart in separate homes, or it may mean the parties remain in the same home, but no longer live or sleep together as a couple.
To obtain a divorce, a couple must be separated for at least one year before they can file for a divorce. Separated couples can remain separated indefinitely without ever filing for divorce. However, if either individual wants to marry for a second (or subsequent) time, they must first obtain a divorce. Once a divorce is finalized, a person’s legal status will officially change to “single”.
