The Difference Between Separation and Divorce
Separation is the first step towards obtaining a divorce. A separated couple remains legally married, but live “separate and apart” from one another. This may mean the parties live apart in separate homes, or it may mean the parties remain in the same home, but no longer live or sleep together as a couple.
To obtain a divorce, a couple must be separated for at least one year before they can file for a divorce. Separated couples can remain separated indefinitely without ever filing for divorce. However, if either individual wants to marry for a second (or subsequent) time, they must first obtain a divorce. Once a divorce is finalized, a person’s legal status will officially change to “single”.
