Oshawa Paternity Lawyers
Paternity involves determining the biological father of a child. Paternity of a child is a crucially important issue because the father of that child has legal and financial obligations towards him or her. As a result, paternity is often brought into question to either avoid those obligations or to compel someone to father of a child. Paternity of a child is a crucially important issue because the father of that child has legal and financial obligations towards him or her. As a result, paternity is often brought into question to either avoid those obligations or to compel someone to fulfil those obligations.
If you wish to file a paternity claim, or if you have had a paternity claim filed against you, it is imperative to consult with a family lawyer who has had experience representing clients in such matters. At
Borden Family Law, we have represented mothers and fathers in paternity disputes for 17 years. Our practice is focused solely on family law and the disputes that often arise among families, including the parentage of children.
Paternity Disputes
In many cases, paternity testing is requested or ordered in situations where
child support is sought from a purported father. In such instances, a declaration of parentage is required under provisions in the
Children’s Law Reform Act.
In some cases, a man believes a child is his and wants to take on legal and financial responsibilities for that child, or become involved in the child’s life, but is blocked from doing so by the child’s mother, who denies the paternity. In such cases, the father has the same rights as a mother in being in a child’s life, with the exception of extenuating circumstances where violence or drug abuse might be involved.
Paternity is not concerned with whether a child was a product of a marriage, a common-law relationship, or a causal relationship. It simply seeks to determine who the biological father of a child is or is not. This is done through a simple DNA test. It’s painless, relatively inexpensive and requires swab samples from both father and child.
