Marriage Agreements

A marriage agreement is commonly referred to as a “pre-nuptial agreement”, “pre-nup” or “marriage contract”.  A marriage agreement sets out the assets each party brings into the marriage, and also lists the assets the other party cannot make claim to in the event of a separation or a divorce. It may also list common property as being exclusive to one party.

Cohabitation Agreements

Cohabitation agreements are essentially pre-nups for couples in common-law relationships and those who live together but are not married. Cohabitation agreements are governed by section 53 of the Family Law Act in Ontario.  Cohabitation agreements set out the rights and obligations of each party to the other during their relationship and also following the end of the relationship. It addresses important matters such as property and asset division. It is important to note that a cohabitation agreement can be turned into a marriage contract if the couple ultimately does marry.
